In zijn uitspraak in zaak C-143/22 | ADDE en anderen heeft het Hof van Justitie van de Europese Unie vandaag geoordeeld dat de Terugkeerrichtlijn van toepassing is op elke derdelander die het grondgebied van een lidstaat is binnengekomen zonder te voldoen aan de voorwaarden voor toegang, verblijf of vestiging. Dit geldt ook wanneer de betrokkene dat grondgebied is binnengekomen voordat hij een grensovergang heeft overgestoken waar dergelijke controles worden uitgevoerd.

In zijn uitspraak in zaak T-600/21 | WS en anderen tegen Frontex heeft het Gerecht van Eerste Aanleg vandaag de vordering van een aantal Syrische vluchtelingen verworpen die een schadevergoeding hadden ingediend bij het Gerecht van de Europese Unie. De verzoekers beweerden dat Frontex niet correct heeft gehandeld.

The return of irregular migrants is one of the main pillars of the EU’s policy on migration and asylum. In this light the EMN will conduct in 2017 a study on ‘The effectiveness of return in EU Member States: challenges and good practices linked to EU rules and standards‘. The synthesis report of this study is expected to be published at the end of 2017. The Belgian national report will probably be published at the beginning of 2018.
