In de Europese Unie zijn naar schatting 400.000 mensen erkend staatloos of hebben geen vastgestelde nationaliteit (UNHCR, 2018). In 2017 waren er niet minder dan 2.100 staatloze kinderen in Europa geregistreerd. Dit is een verviervoudiging t.o.v. 2010. Hoe stellen EU-lidstaten staatloosheid vast? Op 27 oktober 2025 komen belanghebbenden in Luxemburg bijeen om te bespreken hoe het EU-pact inzake migratie en asiel staatloosheid als kwetsbaarheid aanpakt. Terwijl een wetsontwerp dat een nieuw verblijfsrecht voor staatlozen invoert momenteel in het Parlement wordt besproken, benadrukken ENS en Nansen dat het project een groot aantal formele en inhoudelijke voorwaarden en verminderde procedurele garanties bevat. Ze concluderen dat het niet verenigbaar is met de verplichting om een eerlijke, effectieve en toegankelijke procedure te hebben voor de toegang van staatlozen tot hun rechten.
