Belgium applies new family reunification rules
From 18 August 2025, new rules for family reunification enter into force in Belgium. They do not apply to all applicants. Some cases continue under the old rules, others transition to the new rules in 2027, while certain applications are immediately subject to the new framework. This article explains who is affected and how the rules will change.
The old rules continue to apply to family members whose residence was authorised before 18 August 2025. When renewing their residence permits, these individuals must demonstrate compliance with the conditions that were in force prior to the new rules.
For applications submitted before 18 August 2025 but not yet decided by the Immigration Office, and for applications involving a Belgian or a person authorised to stay before 18 August 2025, the old rules apply until 17 August 2027. From 18 August 2027, family members will need to meet the conditions under the new rules. An exception applies to family reunification with beneficiaries of subsidiary or temporary protection: proof of family ties prior to the beneficiary’s arrival in Belgium is not required.
The new rules apply immediately to applications submitted after 18 August 2025 with a Belgian or a person authorised to stay from 18 August 2025 onwards. Changes include a higher minimum age for spouses, revised definitions of adequate housing and sufficient resources, and updated conditions for family reunification with refugees, stateless persons, and beneficiaries of subsidiary or temporary protection.
