Deze ad hoc vraag onderzoekt of de nationale wetgeving voorziet in een formele beslissing tot verlenging van de Dublin-overdrachtstermijn die losstaat van de eigenlijke overdrachtsbeslissing, en of tegen een dergelijke beslissing beroep kan worden aangetekend. Daarnaast brengt het de bestaande wettelijke bepalingen in kaart met betrekking tot onderduiken ("absconding") in samenhang met de verlenging van overdrachtstermijnen. Tot slot peilt de ad hoc vraag naar de nationale praktijken wanneer een verzoeker onderduikt en vervolgens weer verschijnt.

The Netherlands has decided to resume Dublin transfers of single, non-vulnerable male asylum seekers to Belgium, following a period in which such transfers were suspended after a Dutch court ruling. In April 2025, the District Court of The Hague, sitting in Groningen, found that single male asylum seekers risked being deprived of adequate reception conditions in Belgium, which could expose them to inhumane or degrading treatment. The ruling led to a halt in transfers under the EU Dublin system.

The Dutch Council of State has ruled that single male asylum seekers may no longer be transferred to Belgium under the Dublin Regulation. The judgment cites systemic failures in Belgium’s reception and legal protection for this group, exposing them to a real risk of inhuman treatment. These individuals must now remain in the Netherlands while their asylum claims are processed.

Volgens recente cijfers gepubliceerd door Eurostat, heeft België 14.079 uitgaande verzoeken verstuurd om de verantwoordelijkheid voor het behandelen van een asielaanvraag over te dragen onder de Dublin-procedure. Daarmee behoort België tot de top 5 landen die samen 86% van alle uitgaande verzoeken in 2023 hebben verzonden. België rapporteerde ook 1.241 uitgaande overdrachten in 2023.

The European Commission is presenting today a set of good practices to help Member States implement in the most effective way the actions to which they have committed under the Dublin Roadmap. 

Nicole de Moor presented today a draft law which aims, in accordance with the federal government agreement, to enshrine in law a proactive return policy. The draft law inter alia provides for the obligation to cooperate in the return procedure and for the intensive individual follow up of third-country nationals who have received an order to leave the territory.

The Commission recommends today that transfers to Greece should be resumed gradually, only for asylum seekers for whom Greece is responsible from 15 March 2017, and subject to individual assurances from the Greek authorities.
