This Inform maps national approaches to the safe country of origin (SCO) and safe third country (STC) concepts, in the context of the forthcoming Asylum Procedure Regulation applicable from June 2026. It compares legislation, policies and practices governing the designation and application of SCOs and STCs, including the use of national lists, ad hoc assessments and accelerated asylum procedures. The analysis was prepared on the basis of contributions from 26 EMN Member and Observer Countries.

This ad hoc query, which informed the preparation of an EMN Inform, collected information on national lists of safe countries of origin and safe third countries, including their adoption and use. It examined exceptions for specific regions or categories of applicants and the procedures applied to their claims. It also explored the application of the safe third country concept, including assessments, safeguards and practical challenges. Finally, it gathered information on sources used, case law, good practices and planned adaptations to the new Asylum Procedure Regulation.

Deze EMN Inform geeft een overzicht van het beleid en praktijken van (lid)staten met betrekking tot veilige landen van herkomst. Het beschrijft welke landen een lijst met veilige landen van herkomst hebben ingevoerd en of onderdanen van deze landen anders worden behandeld dan onderdanen van andere landen in de procedure voor internationale bescherming. Bovendien worden verschillen met betrekking tot opvangvoorzieningen en terugkeerbepalingen onderzocht.

The European Parliament has approved new EU asylum rules to enable faster processing of asylum requests. The reform establishes a common list of safe countries of origin while allowing Member States to maintain or designate additional safe countries at national level. It also clarifies the conditions under which Member States can apply the safe third country concept. While the legislation has now passed Parliament, it still needs to be formally adopted by the Council before entering into force.

The Council of the European Union has agreed its position on two key proposals to strengthen the use of safe country concepts in EU asylum rules. The Court of Justice rules that designating a country as ‘safe’ must allow effective judicial review

The Court of Justice of the European Union has ruled that a Member State may designate a third country as a ‘safe country of origin’ by legislative act, provided that the designation can be subject to effective judicial review. The judgment clarifies that the sources used for such a designation must be accessible to both applicants and courts. The Court also stated that a country cannot be listed as ‘safe’ if it does not offer adequate protection to all its population.

Op 11-12 mei 2025 bezocht de Belgische Minister voor Asiel en Migratie Anneleen Van Bossuyt Chisinau om te benadrukken dat verzoeken om internationale bescherming van Moldavische staatsburgers—afkomstig uit een land dat als veilig wordt beschouwd—in België via een versnelde procedure worden verwerkt. The European Commission has issued a proposal to accelerate the implementation of certain aspects of the Pact on Migration and Asylum, with the aim of helping Member States process asylum claims more quickly, particularly for applicants whose claims are likely to be unfounded. In addition, the proposal includes the establishment of an EU-wide list of safe countries of origin. Human rights organisations have raised concerns, especially about the inclusion of Egypt, Tunisia, and Morocco, which they argue have ongoing human rights issues.

Nicole de Moor said that applications relating to 859 persons have already been processed in accelerated procedure since February 2024. In 96 % of cases, applicants were not granted protection status. Ms de Moor wants to focus more on prevention to prevent people who do not need protection from applying for international protection in Belgium.

Vandaag, 29 augustus 2016, is het Koninklijk Besluit van 3 augustus die de lijst van veilige landen van herkomst vastlegt, gepubliceerd in het Belgisch Staatsblad. Naast de landen die reeds op de lijst stonden afgelopen jaren, wordt ook Georgië nu als veilig land van herkomst beschouwd.
