Applicants for international protection have 30 days to leave a reception centre after a final negative decision

In order to structurally shorten the duration of reception in Belgium, an amendment was made to the Reception Act. Anyone who receives a final negative asylum decision must leave the reception place within a period of 30 days.

On 9 March 2023, the Belgian government announced a migration deal providing for several reforms focused inter alia on reception. The Secretary of State for Asylum and Migration announced at that time that applicants for international protection who receive a final negative decision would have to leave the reception centre within a period of 30 days.

The law of 14 March 2024 modifying the Reception Act stipulates that "The beneficiary of the reception continues to benefit from material assistance for a period of thirty days, from notification of the final negative decision." This law was published in the Belgian Official Gazette on 17 June 2024.

In a press release from 27 June 2024, the Secretary of State for Asylum and Migration, Nicole de Moor, stressed that from now on, only those who have an ongoing asylum procedure are still entitled to reception. This measure aims at preventing people, after a negative decision, from initiating other procedures, such as an application for regularization, in order to postpone the order to leave the territory.
